AN ACT TO clarify federal preemption of state law governing Operation of Unmanned Aircraft Systems.



The General Assembly of North Carolina enacts:



SECTION 1.  Article 10 of Chapter 63 of the General Statutes is amended by adding a new section to read:



§ 63‑94.1.  Federal authority over airspace.



Nothing in this Article shall preempt or intrude upon the federal government's exclusive sovereignty of airspace as set forth in 49 U.S.C. § 40103. Any interpretation or application of this Article that contradicts the exclusive authority of the federal government to regulate the operation of unmanned aircraft systems shall be null and void.



SECTION 2.  This act is effective when it becomes law.
