AN ACT to allow certain educational organizations to expedite the process to obtain surplus and decommissioned federal material and property.
The General Assembly of North Carolina enacts:
SECTION 1. Part 2 of Article 3A of Chapter 143 of the General Statutes is amended by adding a new section to read:
§ 143‑64.5A. Certain educational institutions exempt.
Notwithstanding any provisions or limitations of Part 2 of this Article, an educational organization is authorized and empowered to obtain decommissioned and surplus material and property under contracts and agreements with the federal government or any of its departments or agencies provided that the material and property is intended to be used for educational purposes. To the extent set forth above and in this section, the provisions of Part 2 of this Article shall not apply to an educational organization. For the purposes of this section, the term educational organization means an organization that has education as its primary purpose and that is a nonprofit organization, a not‑for‑profit organization, or an organization that has tax‑exempt status under 26 U.S.C. § 501(c)(3).
SECTION 2. This act is effective when it becomes law.
