AN ACT to remove certain described property from the corporate limits of the Town of Holly SPRINGS AND TO ESTABLISH A MORATORIUM ON ANNEXATION BY THE TOWN OF LELAND.



 



The General Assembly of North Carolina enacts:



 



part i. holly springs deannexation



SECTION 1.  The following described property, identified by Wake County Parcel Identification Number, is removed from the corporate limits of the Town of Holly Springs: 0648243521.



SECTION 2.  This act has no effect upon the validity of any liens of the Town of Holly Springs for ad valorem taxes or special assessments outstanding before the effective date of this act. Such liens may be collected or foreclosed upon after the effective date of this act as though the property were still within the corporate limits of the Town of Holly Springs.



SECTION 3.  This Part becomes effective June 30, 2023. Property in the territory described in Section 1 of this Part as of January 1, 2023, is no longer subject to municipal taxes for taxes imposed for taxable years beginning on or after July 1, 2023.



 



Part ii. Leland annexation moratorium



SECTION 4.(a)  The authority of the Town of Leland to annex territory under Article 4A of Chapter 160A of the General Statutes is hereby suspended.



SECTION 4.(b)  This section shall not apply to any petition for voluntary annexation which has been executed by petitioners on or before March 1, 2023.



SECTION 5.  This Part is effective when it becomes law.

SECTION 6.  Except as otherwise provided, this act is effective when it becomes law.
