H182: Escheat Fund Fee Waiver.-AB Latest Version

AN ACT to waive feeS for certain properties held in the escheat fund, as recommended by the department of STATE treasurer.
The General Assembly of North Carolina enacts:
SECTION 1. G.S. 7A‑307(b) reads as rewritten:
(b) In collections of personal property by affidavit, the facilities fee and thirty dollars ($30.00) of the General Court of Justice fee shall be paid at the time of filing the qualifying affidavit pursuant to G.S. 28A‑25‑1. If the sole asset of the estate is a cause of action, these fees shall be paid at the time of the qualification of the fiduciary. Upon application of the affiant, all fees shall be waived if (i) the amount to be collected is five thousand dollars ($5,000) or less and (ii) the sole source of the assets of the estate is held in the Escheat Fund pursuant to Article 1A of Chapter 116B of the General Statutes.
SECTION 2. This act becomes effective January 1, 2024, and applies to petitions filed on or after that date.
