AN ACT to provide that a ski patrol member is immune from civil liability for certain acts or omissions COMMITTED while acting in the person's capacity as a ski patrol member.



The General Assembly of North Carolina enacts:



SECTION 1.  Chapter 99C of the General Statutes is amended by adding a new section to read:



§ 99C‑6.  Civil liability exemption for ski patrol members.



(a)        Definitions. – The following definitions apply in this section:



(1)        Compensation. – Wages, salary, commission, or bonuses paid for services rendered. This term does not include the provision, at a discounted price or without charge, of food, beverages, clothing, passes, or other incidental benefits to ski patrol members.



(2)        Ski patrol member. – A registered member of the National Ski Patrol who serves in that capacity without compensation.



(b)        Immunity. – Except as otherwise provided in subsection (c) of this section, a ski patrol member is immune from civil liability for the person's acts or omissions while the person is acting in the person's capacity as a ski patrol member, including the rendering of emergency care.



(c)        Exception. – The immunity conferred under subsection (b) of this section does not apply if the act or omission of the ski patrol member involves reckless, wanton, or intentional misconduct.



SECTION 2.  This act becomes effective October 1, 2023, and applies to acts or omissions occurring on or after that date.
