AN ACT to develop evacuation routes and plans for communities and roads surrounding fixed nuclear facilities and within plume exposure pathway emergency planning zones and to appropriate funds to the division of emergency management.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 166A‑19.15 is amended by adding a new subsection to read:

(h)      Fixed Nuclear Facility Evacuation Plan. – Each county in the State which has an incorporated municipality or unincorporated community located within 5 miles of a fixed nuclear facility or has a Plume Exposure Pathway Emergency Planning Zone within its boundaries shall develop and maintain an evacuation route and plan for the surrounding areas. Each county shall update the plan every three years. The plans shall include evacuation routes for all public and private roads within 5 miles of each fixed nuclear facility or Plume Exposure Pathway Emergency Planning Zone. Each county and municipality shall cooperate with the Department of Public Safety, Division of Emergency Management, in developing local plans for each area.

SECTION 2.  There is appropriated from the General Fund to the Department of Public Safety, Division of Emergency Management, the nonrecurring sum of one hundred thousand dollars ($100,000) for the 2022‑2023 fiscal year to disburse grants to counties to assist the counties in developing evacuation routes and plans in accordance with Section 1 of this act.

SECTION 3.  Section 1 of this act becomes effective October 1, 2022. Section 2 of this act becomes effective July 1, 2022. The remainder of this act is effective when it becomes law.
