AN ACT exempting from certificate of need review the acquisition of magnetic resonance imaging scanners by specialty and multispecialty professional corporations of physicians licensed to practice medicine in north carolina.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 131E‑184 is amended by adding a new subsection to read:

(i)       The Department shall exempt from certificate of need review the acquisition of a magnetic resonance imaging scanner by purchase, donation, lease, transfer, or comparable arrangement by any specialty or multispecialty professional corporation of physicians licensed to practice medicine under Chapter 90 of the General Statutes if the following conditions are met:

(1)        The magnetic resonance imaging scanner will be used only for the patients of that same physician practice or group.

(2)        The single specialty or multispecialty physician practice or group proposing to acquire a magnetic resonance imaging scanner shall provide prior written notice to the Department, along with supporting documentation to demonstrate that it meets the exemption criteria of this subsection.

SECTION 2.  This act becomes effective October 1, 2021.
