AN ACT to improve air quality for north carolina citizens by placing restrictions on heavy truck Idling.

The General Assembly of North Carolina enacts:

SECTION 1.(a)  For purposes of this section, the term Idling Rule refers to 15A NCAC 02D .1010 (Heavy‑Duty Vehicle Idling Restrictions), prior to its repeal by the Department of Environmental Quality on November 1, 2016.

SECTION 1.(b)  Section 4.24 of S.L. 2015‑286 is repealed.

SECTION 1.(c)  The Department of Environmental Quality shall readopt the Idling Rule as that rule existed prior to its repeal, provided that the Department may renumber or reorganize the rule for consistency with other rules readopted by the Department since repeal of the Idling Rule and make other additions or changes in the rule needed to address changes in State or federal law on or after November 1, 2016.

SECTION 2.  This act is effective when it becomes law.
