AN ACT to expedite the determination by the prosecution of whether to seek a change of venue in cases involving the discharge of a firearm and ten or more victims.

The General Assembly of North Carolina enacts:

SECTION 1.  Article 13 of Chapter 15 of the General Statutes is amended by adding a new section to read:

§ 15‑133.1.  Change of venue for the prosecution of mass shootings.

The Court shall not, without the consent of the defendant, grant the State's motion to change the venue of a case involving the discharge of a firearm and 10 or more victims after 90 days have passed from the date of the defendant's initial arrest upon the charges.

SECTION 2.  This act becomes effective December 1, 2021, and applies to offenses committed on or after that date.
