AN ACT to require a current and valid picture of a permittee on a concealed handgun permit.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 14‑415.10 reads as rewritten:

§ 14‑415.10.  Definitions.

The following definitions apply to this Article:



(3)        Permit. – A concealed handgun permit issued in accordance with the provisions of this Article.

(3a)      Photo identification. – A North Carolina drivers license or special identification card issued under G.S. 20‑37.7.

(3b)      Proof of deployment. – A copy of the military permittee's deployment orders or other written notification from the permittee's command indicating the start and end date of deployment and that orders the permittee to travel outside the permittee's county of residence.

SECTION 2.  G.S. 14‑415.13(a) reads as rewritten:

(a)      A person shall apply to the sheriff of the county in which the person resides to obtain a concealed handgun permit. The applicant shall submit to the sheriff all of the following:

(1)        An application, completed under oath, on a form provided by the sheriff, and such application form must be provided by the sheriff electronically. The sheriff shall not request employment information, character affidavits, additional background checks, photographs, or other information unless specifically permitted by this Article.

SECTION 3.  G.S. 14‑415.16(b) reads as rewritten:

(b)      The holder of a permit shall apply to renew the permit within the 90‑day period prior to its expiration date by filing with the sheriff of the county in which the person resides a renewal form provided by the sheriff's office, an affidavit stating that the permittee remains qualified under the criteria provided in this Article, a copy of a current and valid photo identification, a newly administered full set of the permittee's fingerprints, and a renewal fee.

SECTION 4.  G.S. 14‑415.17(a) reads as rewritten:

(a)      The permit shall be in a certificate form, as prescribed by the State Bureau of Investigation, that is approximately the size of a North Carolina drivers license. It shall bear the signature, photo from the photo identification, name, address, date of birth, and the drivers license identification number used in applying for the permit.

SECTION 5.  The State Bureau of Investigation shall adopt rules establishing the size of the photo required and placement on the permit issued under Article 54B of Chapter 14 of the General Statutes. The State Bureau of Investigation may adopt temporary rules to implement the provisions of this section.

SECTION 6.  This act becomes effective October 1, 2021, and applies to permits issued or renewed on or after that date.
