AN ACT to establish a criminal offense for possessing any explosive or incendiary device or material if circumstances indicate the device or material will be used to commit a crime.



The General Assembly of North Carolina enacts:



SECTION 1.  G.S. 14‑49 reads as rewritten:



§ 14‑49.  Malicious use of explosive or incendiary; punishment.



(a)        Any person who possesses any explosive or incendiary device or material when the circumstances indicate some probability that such device or material will be so used to violate this section is guilty of a Class H felony.



(a1)      Any person who willfully and maliciously injures another by the use of any explosive or incendiary device or material is guilty of a Class D felony.

SECTION 2.  This act becomes effective December 1, 2025, and applies to offenses committed on or after that date.
