AN ACT TO Exempt RECORDS containing Revenue Sharing information from public records requirements; To allow constituent institutions to Classify all Graduate Student‑Athletes receiving Full Scholarships as North Carolina Residents for Tuition Purposes; to Expand Permitted Sale of Alcoholic Beverages in Connection with University Sponsored Sports Events; And to remove Certain Limitations on Raffles conducted by constituent institutions and associated nonprofit organizations.



The General Assembly of North Carolina enacts:



 



PART I. EXEMPT RECORDS CONTAINING REVENUE SHARING INFORMATION FROM PUBLIC RECORDS REQUIREMENTS



SECTION 1.  G.S. 132‑1.2 reads as rewritten:



§ 132‑1.2.  Confidential information.



Nothing in this Chapter shall be construed to require or authorize a public agency or its subdivision to disclose any information that:





(12)      Reveals records held by a constituent institution of The University of North Carolina containing information pertaining to the constituent institution's (i) overall revenue sharing budget, (ii) allocations of its revenue sharing budget by team or program, or (iii) allocations of its revenue sharing budget to individual student‑athletes. For the purposes of this subdivision, revenue sharing budget means the revenue that a constituent institution has authorized to be paid to student‑athletes.



 



PART II. CLASSIFY GRADUATE STUDENT‑ATHLETES RECEIVING FULL SCHOLARSHIPS AS NORTH CAROLINA RESIDENTS



SECTION 2.  G.S. 116‑143.6 reads as rewritten:



§ 116‑143.6.  Full scholarship students attending constituent institutions.



(a)        Notwithstanding any other provision of law, if the Board of Trustees of a constituent institution of The University of North Carolina elects to do so, it may by resolution adopted consider as residents of North Carolina all persons who receive full scholarships to the institution from entities recognized by the institution and attend the institution as undergraduate or graduate students. The aforesaid persons shall be considered residents of North Carolina for all purposes by The University of North Carolina.

PART III. EXPAND PERMITTED SALE OF ALCOHOLIC BEVERAGES IN CONNECTION WITH COLLEGE SPORTS EVENTS



SECTION 3.  G.S. 18B‑1006(a) reads as rewritten:



§ 18B‑1006.  Miscellaneous provisions on permits.



(a)        School and College Campuses. – No permit for the sale of alcoholic beverages shall be issued to a business on the campus or property of a public school, college, or university. This subsection shall not apply to the following:





(10)      A stadium, athletic facility, or arena on the campus or property of a public college or university, if the Board of Trustees of the public college or university has voted to allow the issuance of permits for use at that stadium, athletic facility, or arena. If a Board of Trustees votes to allow the issuance of permits in accordance with this subdivision, the Board of Trustees shall provide written notice to the Commission that it has voted to allow the issuance of permits. Any permit described in G.S. 18B‑1001, 18B‑1002(a)(2), or 18B‑1002(a)(5) may be issued pursuant to this subdivision to applicants meeting the requirements for the requested permit. Notwithstanding the issuance of a mixed beverages permit pursuant to G.S. 18B‑1001(10), this subdivision does not authorize the sale of mixed beverages when the stadium, athletic facility, or arena is being used for a sports event sponsored by the public college or university. This subdivision does not apply to any sales authorized under subdivisions (1) through (8) of this subsection. For purposes of this subdivision, the premises of a stadium, athletic facility, or arena shall include any area that meets all of the following requirements:



a.         Is either of the following:



1.         Is within 500 feet of the furthest exterior building wall, perimeter fence, or permanent fixed perimeter.perimeter of the stadium, athletic facility, or arena.



2.         Is within a designated satellite area on the campus or property of the public college or university during the period of time beginning six hours before a sports event sponsored by the public college or university in the stadium, athletic facility, or arena and ending three hours after the conclusion of the sports event.



b.         Is designated by the stadium, athletic facility, or arena in a map or written description that clearly defines the boundary of the area, and that map or written description is included in the permit application.



c.         Can be designated in a manner that enables the stadium, athletic facility, or arena to ensure compliance with the provisions of this Chapter.

PART IV. REMOVE LIMITATIONS ON CERTAIN RAFFLES



SECTION 4.  G.S. 14‑309.15 reads as rewritten:



§ 14‑309.15.  Raffles.





(i)         The restrictions in subsections (c) through (g) of this section do not apply to raffles conducted by constituent institutions of The University of North Carolina or nonprofit organizations affiliated with a constituent institution of The University of North Carolina.



 



PART V. EFFECTIVE DATE



SECTION 5.  This act is effective when it becomes law and applies beginning with the 2026‑2027 academic year.
